By accessing and using Motion Archive, you agree to comply with and be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service.
2. Digital Assets License
All items purchased are subject to the following license terms:
You are granted a non-exclusive, non-transferable license to use the assets in your personal or commercial projects.
Redistribution or resale of the raw project files or assets is strictly prohibited.
You may not claim the assets as your own original work.
3. Refunds Policy
Due to the digital nature of our products, all sales are final. Once a download link has been generated or files have been accessed, we cannot offer refunds unless the file is proven to be defective.
4. Right of Withdrawal (EU/EEA Consumers)
Consumers in the EU/EEA normally have 14 days to withdraw from an online purchase. Two statutory exceptions under Article 16 of the Consumer Rights Directive (2011/83/EU) apply to what we sell, and by placing an order you expressly acknowledge them:
Personalised items. Every ident, outro and animation is produced to your specification — the name, handle, colours, imagery and other options you submit at checkout. Goods made to a consumer's specifications or clearly personalised are exempt from the right of withdrawal, and that exemption applies from the moment we begin production on your order.
Digital content supplied immediately. Where an item is delivered as digital content rather than on a physical medium, you give your prior express consent for delivery to begin as soon as your payment is confirmed, and you acknowledge that you thereby lose your right of withdrawal once delivery has started.
Because of this, we are unable to accept withdrawal requests once work on a personalised order has begun or once a download has been made available to you.
This does not affect your statutory rights where an item is faulty, does not match its description, or is not delivered. If something is wrong with your order, contact us and we will correct it, re-deliver it, or refund it as appropriate. Nothing in this section limits rights that cannot be limited by law.
5. Delivery Terms
Digital delivery timing, download availability windows, re-delivery requests, and buyer download responsibilities are governed by our Delivery Policy, which forms part of these Terms of Service.
6. Accounts
You are responsible for maintaining the confidentiality of your access links and order information. Motion Archive is not liable for unauthorized access resulting from your failure to protect your credentials.
7. Data Collection & Analytics
By using Motion Archive, you consent to the following data collection practices, which are necessary for platform security, fraud prevention, and service improvement:
IP address logging — your IP address is recorded on every page visit, purchase, spin wheel use, and authentication event.
Device fingerprinting — a unique device identifier is stored in a browser cookie (motion_did) to identify your device across sessions for security purposes.
Page view tracking — every page you visit is logged, including the URL, HTTP referrer, browser user agent, and timestamp.
Interaction tracking — on-site interactions such as product clicks, search queries, cart additions, and checkout steps may be recorded to help us understand usage patterns and improve the platform.
Behavioural analytics — aggregated and per-user analytics including most-visited pages, purchase patterns, and engagement metrics are used internally for platform development.
All collected data is stored securely and used exclusively for the purposes outlined in our Privacy Policy. We do not sell your data to third parties.
You may request deletion of your data at any time by emailing support@motionarchive.eu from the address on your account, or by opening a support ticket in your Client Portal. We will remove everything that identifies you. Two limits apply, and they are set out in full in our Privacy Policy:
We must retain the transaction record itself — order number, amounts, fees and dates — in anonymised form, because tax and accounting law requires it. Nothing in it will connect the sale to you.
Payments are handled by Stripe and card details never reach our servers, so we can only erase data held on our own platform. Stripe's own records must be requested from Stripe directly.
8. Prohibited Conduct
You agree not to:
Attempt to bypass security measures, ban systems, or access controls.
Use automated bots or scrapers on the platform without explicit permission.
Engage in chargebacks or payment fraud.
Share, resell, or redistribute purchased digital assets.
Impersonate other users, sellers, or Motion Archive staff.
Violations may result in account termination, IP bans, and referral of fraudulent activity to payment processors.
9. Limitation of Liability
Motion Archive provides assets "as is" without warranty of any kind. We are not responsible for any technical issues or hardware limitations that may occur while using our assets.
